PEDAL SPICE PRIVACY POLICY

Wampler Pedals, Inc. ("Wampler Pedals," "we," "us," or "our") respects your privacy. This Privacy Policy describes how we collect, use, disclose, and safeguard personal information in connection with the Pedal Spice circuit simulation software and related services (the "Service"). By using the Service, you consent to the practices described in this Privacy Policy.
1. Information We Collect
1.1. Account information. When you create an account, we collect your email address and, if you provide it, your name.
1.2. Content. We store the circuits, schematics, and files you create or upload using the Service.
1.3. Subscription and usage data. We maintain records of your plan, trial dates, usage counts (such as audio renders), subscription status, and use of features of the Service, including when you reach a plan limitation.
1.4. Technical data. When you register for and sign in to the Service, we collect the network (IP) address from which your device connects, together with basic technical information such as browser type and operating system. We use this information to secure the Service and to detect and prevent abuse, including the creation of multiple accounts to obtain repeated trial periods.
1.5. Payment information. Payments are processed by Stripe, Inc. ("Stripe"). We do not receive or store your full payment card number. We receive from Stripe confirmation of payment, the last four digits and type of your payment method, and transaction identifiers. Stripe's collection and use of your information is governed by Stripe's privacy policy.
1.6. Communications. If you contact us, we retain the correspondence and any information you provide.
2. How We Use Information
We use the information we collect to: (a) provide, operate, maintain, and improve the Service, including storing your content and administering your account; (b) process payments and manage subscriptions; (c) send you transactional communications, including account, security, and billing notices; (d) send you marketing communications about Pedal Spice and related Wampler Pedals products, services, and offers, as described in Section 3; (e) respond to your inquiries and provide support; (f) monitor and analyze usage to improve the Service; (g) detect, prevent, and address fraud, abuse, security incidents, and violations of our Terms of Service; and (h) comply with legal obligations.
3. Marketing Communications
By creating an account, you consent to receive marketing email from Wampler Pedals, Inc. regarding Pedal Spice and related products, services, and offers. Each marketing email will include a means to unsubscribe. You may opt out of marketing email at any time by using that unsubscribe link or by contacting us at legal@wamplerpedals.com. Opting out of marketing email does not affect transactional communications, which we will continue to send as necessary to administer your account.
4. Disclosure of Information
We do not sell personal information. We may disclose personal information: (a) to service providers that perform services on our behalf, including our hosting and application platform provider (Base44), our payment processor (Stripe), and our email delivery provider, each of which is authorized to use personal information only as necessary to provide its services to us; (b) to Meta Platforms, Inc. ("Meta"): our website and its server send Meta your page visits, sign-ups, free trial starts, Pedal Spice for Teams form sends and purchases, to measure and run our ads, and never your payment card details (see section 8); (c) to comply with applicable law, regulation, legal process, or governmental request; (d) to enforce our Terms of Service and protect the rights, property, or safety of Wampler Pedals, our users, or others; and (e) in connection with a merger, acquisition, financing, or sale of all or a portion of our business, subject to the acquiring party's agreement to honor this Privacy Policy.
5. Data Retention
We retain personal information for as long as your account remains active and as necessary to fulfill the purposes described in this Privacy Policy. If you delete your account, or request that we do so, we will delete your account information and content within thirty (30) days, except that we may retain billing and transaction records for as long as required by applicable tax, accounting, and legal obligations, and information in backups until those backups are overwritten in the ordinary course.
6. Your Rights and Choices
6.1. You may export your circuits from the Service at any time.
6.2. You may unsubscribe from marketing email as described in Section 3.
6.3. Depending on your jurisdiction, you may have the right to access, correct, delete, or restrict the processing of your personal information, or to receive a copy of it in a portable format. To exercise these rights, contact us at legal@wamplerpedals.com. We will respond in accordance with applicable law and may need to verify your identity before acting on your request.
7. Cookies and Similar Technologies
The Service uses cookies and similar browser storage technologies solely to maintain your signed-in session and to make the editor function. Apart from the Meta pixel described in Section 8, we do not use advertising or third-party tracking cookies. Disabling these technologies in your browser may prevent the Service from functioning.
8. Meta Pixel and Advertising Measurement
Our website at pedalspice.com and the Pedal Spice drawing screen at app.pedalspice.com use the Meta pixel, a tool from Meta Platforms, Inc. ("Meta"), to measure how well our ads on Facebook and Instagram work. The pixel places cookies in your browser and tells Meta when you view one of these pages.
We also send Meta, from our own server, a record of these actions: viewing a page, viewing the pricing page, creating an account, starting the free trial, starting a checkout, sending the Pedal Spice for Teams form, paying for a plan, and each renewal of a plan. Each record can include the page address, your browser type and version, your network (IP) address, and the Meta cookie values in your browser; and, when we have them, your email address, your first and last name, your account number, and the country and ZIP or postal code from your payment details, each scrambled (hashed) before it is sent so that it cannot be read. For a payment or a renewal it also includes the amount and currency. We do not send Meta your circuits, your password, or your payment card details.
Meta uses this information to measure and improve our ads and as described in Meta's own privacy policy. You can manage how Meta uses information from other websites and apps to show you ads in your Meta ad settings at https://www.facebook.com/adpreferences/ad_settings.
9. Security
We implement reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
10. Children's Privacy
The Service is not directed to children under thirteen (13) years of age, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, contact us at legal@wamplerpedals.com and we will delete it.
11. International Users
The Service is operated from the United States. If you access the Service from outside the United States, you acknowledge that your information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those of your jurisdiction.
12. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. The "Last updated" date at the top indicates when it was last revised. For material changes, we will provide notice by email or by a prominent notice within the Service. Your continued use of the Service after the effective date of any revision constitutes your acceptance of the revised Privacy Policy.
